                                                                                                                                                                  La presente lezione è dedicata alla responsabilità dello Stato (legislatore, amministratore e giudice) per danni causati ai singoli da violazioni del diritto UE. Tale responsabilità trova il proprio fondamento giuridico nell’art. 4 del TUE, secondo cui, “in virtù del principio di leale collaborazione, l’Unione e gli Stati membri si rispettano e si assistono reciprocamente nell’adempimento dei compiti derivanti dai trattati”, sicchè “gli Stati Membri adattano ogni misura di carattere generale e particolare atta ad assicurare l’esecuzione degli obblighi derivanti dai trattati”. Nell’analizzare tale tematica si è cercato di ricostruire brevemente il sistema delle fonti UE per poi soffermarsi, in particolare, sulle direttive e sulla loro mancata attuazione da parte degli stati membri. Infine, si è delineata la natura della responsabilità dello Stato legislatore, amministratore e giudice e i presupposti per la sua sussistenza e per ottenere un eventuale risarcimento del danno.

L’AUTORE

Dottoressa Alessandra Pasqualetto, laureata in giurisprudenza presso l’Università degli Studi di Trento nel 2011 con votazione 110/110.

Ha conseguito il dottorato di ricerca presso l’Università di Padova nel 2019 con la tesi “La prevedibilità del danno nell’illecito contrattuale. Problemi e prospettive”. Abilitato all’esercizio della professione forense nel 2014. Ha svolto il tirocinio formativo ex art. 73 del D.L. 69/2013 presso il Tribunale di Padova dal gennaio 2014 al luglio 2015. Idonea al concorso di magistratura ordinaria indetto con D.M. 31/05/2017. In attesa di nomina.
